This Agreement ("Agreement") is entered into by and between Campbell Credit Solutions LLC, hereinafter referred to as "Campbell," and Party signing this agreement, hereinafter referred to as the "Client" or "CRO." This Agreement shall become effective on the date this agreement is signed and shall remain in effect as outlined herein.
RESPONSIBILITIES OF THE PARTIES AND DELIVERABLES
Campbell Credit Solutions LLC agrees to provide the following deliverables on a MONTHLY/WEEKLY basis:
-Reviewing credit reports through credit monitoring, with information supplied by the CRO.
-Drafting dispute letters, collecting responses, and updating the portal as directed by the CRO.
-Conducting regular communication with clients as needed.
-Handling the drafting, printing, and mailing of disputes (excluding certified mail, as described below).
-Filing complaints with the Consumer Financial Protection Bureau (CFPB), Attorney General (AG), and/or Federal Trade Commission (FTC) when deemed necessary.
Campbell Credit Solutions LLC operates under the direction and request of the CRO, maintaining direct contact with the CRO's clients. The company will not handle any customer closing activities at this time.
RECEIVABLES
The CRO agrees to pay $25.00 per round per client to Campbell Credit Solutions LLC before processing the clients. Additionally, the CRO will reimburse Campbell Credit Solutions LLC for expenses incurred outside the normal course of business, including the cost of certified mailing.
Payment for services rendered is not dependent on the outcomes of credit repair services, and results are not guaranteed.
TERM
Either party may terminate this agreement with a 15-day written notice. No refunds will be provided for work already performed by Campbell Credit Solutions LLC at the time of cancellation or at any time. This agreement is independent of any agreement between the CRO and its clients, and Campbell Credit Solutions LLC will be compensated for its work on a file regardless of whether an individual client pays the CRO.
RELATIONSHIP
This Agreement does not create an exclusive arrangement between the parties. Both parties are free to enter into similar agreements with other parties. The relationship established by this Agreement is that of independent contractors, and neither party acts as an agent, representative, partner, or employee of the other.
The Agreement may be modified by written agreement (an "Amendment") between the Parties.
Responsibilities under this Agreement may not be assigned to another party without the written consent of both parties.
DISPUTE RESOLUTION
In the event of a dispute, the parties agree to negotiate in the best interest of all parties. If negotiation fails, the parties agree to binding arbitration, governed by CA law.
If any provision of this Agreement is deemed invalid, unlawful, void, or unenforceable, the provision shall be severed without affecting the validity or enforceability of the remaining Agreement.
LIMITATION OF LIABILITY
Except as prohibited by law, the Client agrees to hold Campbell Credit Solutions LLC and its officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damages arising from this Agreement. If liability is found on the part of Campbell Credit Solutions LLC, it will be limited to the amount paid for the products and/or services.
Campbell Credit Solutions LLC reserves the right to refuse or cancel service for any reason. The CRO represents that it is compliant with the Credit Repair Organizations Act (CROA) and all applicable federal, local, and state laws and licensing requirements, authorized to provide credit repair services to its clients and customers.
